IP protection in Kosovo.*
Kosovo* has an established trademark registration system administered by the Kosovo Industrial Property Agency (KIPA), operating under the Ministry of Industry, Entrepreneurship and Trade. Trademark rights are acquired through registration with KIPA.
One important practical distinction: Kosovo* is not a member of WIPO and is not party to the Madrid Protocol. This means that international trademark registrations filed through the Madrid System do not extend to Kosovo* - protection can only be obtained through a direct national application filed with KIPA.
Foreign applicants without a registered business or residence in Kosovo* must appoint a local authorised representative for all proceedings before KIPA.

Registration
Trademark registration in Kosovo.*
Applications are filed directly with KIPA. Kosovo* follows the first-to-file principle. The application must include a representation of the mark and a list of goods and services classified under the Nice Classification.

Oppositions

Kosovo* has a functioning opposition system. Third parties may file an opposition within 3 months of publication. This deadline cannot be extended.
The applicant has 60 days to respond to the opposition. This deadline also cannot be extended - no supplementary submissions are permitted after expiry. If the applicant fails to respond, the application is refused within the scope of the opposition.
Non-use cancellation is available after 5 years of continuous non-use. Any natural or legal person protecting the interests of producers, service providers, traders or consumers may file the request. There is no requirement to demonstrate a specific legitimate interest beyond this broad standing.
Appeals against KIPA decisions go to the Appeals Commission within 30 days, and subsequently to the competent court within 30 days.

Kosovo* offers civil, administrative and criminal enforcement channels for trademark owners.
Civil proceedings
Competent courts
Courts with jurisdiction over trademark matters. Rights holders can seek a declaration of infringement, injunctions, seizure and destruction of infringing goods, and damages. Civil claims must be filed within 3 years of becoming aware of the infringement, and no later than 5 years from the date of infringement.

Kosovo Customs Service
The Kosovo Customs Service has IP protection powers under Law No. 03/L-170. Rights holders can file an application for customs action. Once approved, customs can suspend the release of suspected infringing goods.

Rights holders can file a complaint with the relevant market inspectorate against trademark infringers.

Fines for legal entities range from €5,000 to €15,000; for responsible persons within legal entities from €500 to €1,500.

The absence of the Madrid Protocol means that rights holders who have secured coverage across the rest of the Balkans through Madrid designations need to file a separate national application in Kosovo* to obtain protection there.
